हिट एंड रन प्रकरणों में आहत/पीडि़त पक्ष को मुआवजा प्राप्त होने के विषय पर निगरानी हेतु गठित की गई है कमेटी
रायगढ़, 15 मार्च 2024/ माननीय उच्चतम न्यायालय द्वारा रिट पीटिशन (सिविल) क्रमांक 295/2012 एस.राजासीकरन विरूद्ध यूनियन ऑफ इंडिया में पारित आदेश के परिपालन में अध्यक्ष जिला विधिक सेवा प्राधिकरण/जिला न्यायाधीश श्री अरविंद कुमार सिन्हा द्वारा गठित मॉनिटरिंग कमेटी की प्रथम बैठक जिला न्यायालय के सभागार में आयोजित की गई। उक्त कमेटी सभी हिट एंड रन प्रकरणों में आहत/पीडि़त पक्ष को मुआवजा प्राप्त होने के विषय पर निगरानी हेतु गठित की गई है।
उक्त विषय पर श्रीमती स्मिता श्रीवास्तव सिन्हा, सचिव जिला विधिक सेवा प्राधिकरण द्वारा जानकारी दी गई की जानकारी के अभाव में लोग उक्त योजना का लाभ नहीं उठा पा रहे। हिट एंड रन दुर्घटनाओं के पीडितों के लिए केंद्र सरकार द्वारा बनाई गई योजना के तहत मुआवजा देने की निराशाजनक दर को ध्यान में रखने हुए माननीय सुप्रीम कोर्ट ने कई निर्देश जारी किए गए है।
मोटर वाहन अधिनियम 1988 की धारा 161 के अनुसार, केद्र सरकार ने हिट एंड रन मोटर दुर्घटना पीडितों के लिए मुआवजा योजना, 2022 बनाई है, जो 1 अपै्रल, 2022 से प्रभावी है। इस योजना के अनुसार, जिसमें सड़क दुर्घटनाकारित वाहन की पहचान नहीं की जा सकती, क्रमश: 2 लाख और 50000 रूपये का भुगतान किया जाता है। उक्त मॉनिटरिंग कमेटी का यह कार्य होगा की वह ऐसे हिट एण्ड रन मामले जिसमें आहत या मृत्यु की दशा में उसके आश्रितों द्वारा योजना के अधीन क्षतिपूर्ति का दावा नहीं किया गया है उन्हें योजना की उपलब्धता के बारे में सूचित करें और दावे दायर करने में सहायता करे उक्त योजना में मुख्य प्रावधान है कि यदि दुर्घटना में शामिल वाहन का विवरण क्षेत्राधिकार पुलिस स्टेशन द्वारा दुर्घटना के संबंध में रिपोर्ट दर्ज करने के समय उपलब्ध नहीं है और यदि, उचित प्रयास करने के बाद भी दुर्घटना में शामिल वाहन का विवरण उपलब्ध नहीं हो सका है तो दुर्घटना रिपोर्ट दर्ज होने की तारीख से एक महीने की अवधि के भीतर पुलिस द्वारा सुनिश्चित किया जाएगा, की मामला योजना के अंतर्गत आता है। पुलिस स्टेशन का प्रभारी अधिकारी घायल या मृतक के कानूनी प्रतिनिधियों, जैसा भी मामला हो, उसको लिखित रूप में सूचित करेगा कि योजना के तहत मुआवजे का दावा किया जा सकता है। पुलिस द्वारा घायलों या मृतक के कानूनी प्रतिनिधियों को, जैसा भी मामला हो, संपर्क विवरण जैसे ई-मेल आईडी और क्षेत्राधिकार दावा जांच अधिकारी का कार्यलय पता प्रदान किया जाएगा।
पुलिस स्टेशन का प्रभारी अधिकारी दुर्घटना की तारीख से एक महीने के भीतर योजना के खंड 21 के उप-खंड (1) में दिए गए अनुसार एफएआर को दावा जांच अधिकारी को अग्रेषित करेगा। उक्त रिपोर्ट की कॉपी अग्रेषित करने समय चोट के मामले में पीडितों के नाम और मृत पीडित के कानूनी प्रतिनिधियों के नाम (यदि पुलिस स्टेशन के पास उपलब्ध हो) भी क्षेत्राधिकार वाले दावा जांच अधिकारी को भेजे जाएंगे, जो इसे अलग रजिस्टर में दर्ज किया जाए। दावा जांच अधिकारी द्वारा पूर्वोक्त एफएआर और अन्य विवरण प्राप्त होने के बाद यदि दावा आवेदन एक महीने के भीतर प्राप्त नहीं होता है तो दावा जांच अधिकारी द्वारा संबंधित जिला विधिक सेवा प्राधिकरण को दावेदारों से संपर्क करने और दावा ओवेदन दाखित करने में उनकी सहायता करने अनुरोध के साथ जानकारी प्रदान की जाएगी।
प्रत्येक जिला स्तर पर मॉनिटरिंग समिति का गठन किया जाएगा, जिसमें जिला विधिक सेवा प्राधिकरण के सचिव, जिले के दावा जांच अधिकारी या, यदि एक से अधिक है, तो राज्य सरकार द्वारा नामित दावा जांच अधिकारी शामिल होगे। पुलिस अधिकारी, जो पुलिस डिप्टी सुपरिटेडेंट के स्तर से नीचे का न हो, जिसे जिला पुलिस सुपरिटेंडेंट द्वारा नामित किया जा सके। जिला विधिक सेवा प्राधिकरण के सचिव मॉनिटरिंग समिति संयोजक होंगे। जिले में योजना के कार्यान्वयन और उपरोक्त निर्देशों के अनुपालन की निगरानी के लिए समिति हर दो महीने में कम से कम एक बार बैठक करेगी। दावा जांच अधिकारी यह सुनिश्रित करेगा कि उसकी सिफारिश और अन्य दस्तावेजों वाली रिपोर्ट विधिवत भरे हुए दावा आवेदन की प्राप्ति से एक महीने के भीतर दावा निपटान अधिकारी को भेज दी जाए।
